Litigation

In its role as an advocate for the profession, the ISBA becomes involved in litigation on legal issues of significance to the membership and the Illinois bar. ISBA involvement in litigation primarily takes the form of filing amicus curiae briefs in appellate matters but sometimes includes more direct participation as a party. The ISBA most often participates in matters dealing with such issues as: the primacy of the Illinois Supreme Court in regulating lawyers, preserving judicial discretion, defining and interpreting the meaning of the practice of law, supporting the attorney-client privilege and attorney-client relationships, protecting the public from the unauthorized practice of law, and the interpretation of ethical standards.
