The Seventh Circuit considered an appeal of the defendant’s counterclaims in a lawsuit involving trademark claims. The counterclaims filed by the defendants included various claims against the plaintiffs relating to the assets of an estate and generally alleged that the defendant’s father was entitled to a portion of the estate of the defendant’s grandfather. The district court dismissed the counterclaims and defendants appealed. The Seventh Circuit affirmed, finding that the counterclaims relating to the distribution of the assets of the estate were not timely. (SCUDDER and PRYOR, concurring)
