Plaintiff filed a lawsuit in Illinois state court against a corporation and its parent company after her husband died when he was exposed to a toxic chemical while at work. Defendants removed the case to federal court under diversity jurisdiction and plaintiff subsequently dismissed one of the defendants, leaving the parent company as the sole remaining defendant. The district court then granted summary judgment in favor of the remaining defendant and plaintiff appealed. The Seventh Circuit affirmed, finding that the parent company was not liable for the actions of its subsidiary under Illinois law. (SCUDDER and ST. EVE, concurring)
