Plaintiff filed a lawsuit against the City of Berwyn as well as the city's mayor and a city inspector, alleging violations of his due process rights under the Fourteenth Amendments as well as state law claims arising out of an incident where the city inspector used racial slurs directed at the plaintiff. The district court dismissed the complaint under FRCP 12(b)(6) for failure to state a federal claim and declined to exercise supplemental jurisdiction over the state law claims and plaintiff appealed. The Seventh Circuit affirmed, finding that the conduct described in the complaint, while “despicable,” fell far short of the conduct necessary to support a substantive due process claim. (ST.
