Plaintiff filed a lawsuit for breach of contract against a company the plaintiff had entered into a sales representative agreement with, alleging that the defendant had breached the agreement between the parties when it refused to pay sales commissions. The complaint also alleged unjust enrichment and violation of the Illinois Sales Representative Act. The parties filed cross-motions for summary judgment and the district court granted partial summary judgment for the plaintiff. The remaining issues went to trial and a jury found in favor of the plaintiff and awarded damages for failure to pay commissions. Defendant appealed from the trial court’s order granting partial summary judgment in favor of the plaintiff. The Seventh Circuit affirmed, finding that the district court did not err when it found that an oral agreement between the parties was valid because the terms of the agreement were sufficiently definite.
