Plaintiff brought a Fair Credit Reporting Act claim against defendant Equifax, a credit reporting agency, after her application for a mortgage was denied subsequent to the lender’s review of a “tri-merge” credit report that aggregated data received from the Equifax, CreditLink, and TransUnion credit reporting agencies. The district court entered summary judgment for defendant Equifax after finding that the information in its report was all true. The Seventh Circuit affirmed, explaining that the Equifax consumer report and file did not contain inaccuracies. The court noted that there were inaccuracies in the CreditLink data, but that Equifax could not be held liable for the other agency’s report and, as a result, Equifax did not cause the denial of the plaintiff’s loan application.
