Plaintiff brought a federal lawsuit against its former partners to a real estate development contract alleging claims for breach of contract and tortious interference with a contractual relationship. The district court granted the defendants’ motion for summary judgment and plaintiff appealed. The Seventh Circuit affirmed, finding that the district court correctly held that the contract between the parties did not give the plaintiff the right to unilaterally select an appraiser from the list of successors that had been agreed on and, as a result, plaintiff did not comply with the terms of the option so that a contract was never formed.
