Plaintiffs brought constitutional and state law claims against the City of Wauwatosa after the city enacted a limited curfew in advance of the announcement of the decision not to criminally charge a police officer who was involved in a shooting while on duty. Plaintiffs had attended protests or were otherwise affected by the curfew order. Defendant ultimately prevailed on all of plaintiffs’ claims and plaintiffs filed an appeal alleging errors at each stage of the proceedings. The Seventh Circuit affirmed, finding that the district court properly held that the defendant imposed a permissible time, place, and manner restriction under the First Amendment and that the district court did not abuse its discretion in answering questions from the jury.
