Plaintiff filed a lawsuit under 42 U.S.C. ยง 1983 against defendants for allegedly conducting an unreasonable search and seizure in violation of the Fourth Amendment and for racial profiling in violation of the Equal Protection Clause. The district court granted defendants qualified immunity and summary judgment on the equal protection claim and the Fourth Amendment claim related to the initial stop and frisk. A jury found the officers not liable on the Fourth Amendment claim regarding the continued detention beyond the original stop and frisk. On appeal, plaintiff argued that the trial court improperly granted the officers qualified immunity and summary judgment and improperly declined to grant him judgment as a matter of law. The Seventh Circuit affirmed the grant of summary judgment on the equal protection claim but found that the officers were not entitled to qualified immunity or summary judgment on the unreasonable search and seizure claims and remanded for a new trial on those issues.
