Eighth Amendment - Deliberate Indifference
Plaintiff, as personal representative of an estate of a deceased individual, filed a lawsuit after the decedent died due to a failure to receive appropriate medical care while an inmate in state prison. Plaintiff brought an Eighth Amendment deliberate indifference claim as well as a state law medical malpractice claim. Plaintiff ultimately dismissed the medical malpractice claim and the district court granted summary judgment in favor of one of the defendants on the deliberate indifference claim and plaintiff appealed. The Seventh Circuit affirmed, finding that plaintiff failed to present sufficient evidence for a reasonable jury to find the defendant liable in her individual capacity. (ST.
