Plaintiffs filed a complaint seeking review of a conditional use permit and variation granted to the defendant by the county in connection with the construction and operation of a wind energy farm. The trial court granted defendant’s motion to dismiss on some counts of the complaint and subsequently granted summary judgment in favor of the defendant on the remaining counts. The plaintiffs appealed, arguing that the trial court erred in denying their motion to compel discovery, in dismissing two counts of the complaint, and in granting summary judgment on an additional two counts of the complaint. The appellate court affirmed, finding that the trial court properly denied plaintiff’s motion to compel, properly dismissed two counts, and properly granted summary judgment on two counts.
