Plaintiff filed a lawsuit after she was injured in a hospital parking lot when a descending parking lot gate struck her on the head while she was driving a motorcycle. The trial court granted defendant’s motion for summary judgment by finding that the hospital did not owe the plaintiff a duty of care because the condition of the parking lot gate was open and obvious where there were signs warning of the potential risk to motorcycle operators. The appellate court agreed and affirmed. (ODEN JOHNSON and C.A. WALKER, concurring)
