Defendant, a senior living facility, appealed from a trial court order granting class certification to plaintiff and other former employees of the defendant who alleged that the defendant violated the Biometric Information Privacy Act when it required its employees to use a time keeping system that collected and analyzed employees’ facial geometry without their knowledge or consent. The appellate court affirmed, finding that the circuit court did not abuse its discretion when certified the class and when it determined that plaintiff, as a former employee of the defendant, was an adequate representative of the class.
