Respondent was committed to institutional care in a secure treatment facility as a sexually violent person until he was released pursuant to a conditional release plan that included 68 enumerated conditions. Respondent appealed from the plan, raising multiple challenges to the imposition and scope of the conditions. The appellate court reversed and remanded with instructions to modify the conditional release plan, explaining that because of the generic nature of the conditional release plan that was approved the appellate court could not conclude whether it complied with the statute and noting that a non-individualized plan not only impaired the respondent’s rights but also potentially jeopardized community safety.
