Plaintiff was awarded duty disability benefits under the Illinois Pension Code. The defendant subsequently terminated the benefits after a disability status hearing by finding that she was no longer disabled as a result of her duty-related injuries. Plaintiff filed a complaint for administrative review and the circuit court reversed the board’s decision, finding it was against the manifest weight of the evidence where the Chicago Police Department would not reinstate plaintiff for medical reasons. The circuit court also awarded plaintiff attorney fees and costs. The appellate court affirmed the circuit court decision and remanded for calculation of the additional fees and costs owed to the plaintiff based on the appeal.
