Respondent in Discovery
In a case brought alleging negligence and violations of the Nursing Home Care Act, the appellate court considered the question of whether the respondent in discovery statute allows a plaintiff to name as a respondent in discovery a person or entity believed in good faith to have information that may lead to additional defendants other than the respondent in discovery. The court held that section 2-402 of the Code of Civil Procedure does not limit additional defendants only to the respondent in discovery and affirmed the order of the circuit court consistent with its holding and remanded for further proceedings.
