People v. Illinois Commerce Commission

Petitioner appealed from a decision by the Illinois Commerce Commission approving the respondent’s beneficial electrification plan under the Electric Vehicle Act. On appeal, the petitioner argued that the commission erred by interpreting the Act to allow non-transportation related spending in beneficial electrification plans. The appellate court disagreed and affirmed, finding that the commission’s interpretation of the statue was consistent with its plain language and that to find otherwise would require the court to read additional language into the statute.
