Illinois Appellate Court
Civil Court
Workers' Compensation Act
Claimant sought benefits under the Workers’ Compensation Act. The arbitrator denied the request for benefits finding that claimant failed to meet her burden of proving she sustained a compensable injury. The Illinois Workers’ Compensation Commission reversed and awarded temporary total disability. The circuit court affirmed the commission and respondent appealed. The appellate court affirmed the circuit court, finding that the evidence submitted during the arbitration hearing, including claimant’s testimony and medical records, was sufficient to support a finding that she sustained repetitive physical trauma as a result of her work-related duties as a dental hygienist.
