Petitioner appealed from a ruling of the Electoral Board of Rich Township striking plaintiff’s name from the ballot for the office of township supervisor. Petitioner argued on appeal that his name should not have been stricken from the ballot because there was no evidence of a pattern of fraud or false swearing in his nomination papers in violation of the Illinois Election Code. The appellate court reversed, finding that it could not affirm the board’s findings where they were not supported by clear and convincing evidence of a pattern of fraud or false swearing.
