Residential Property Disclosure Act
Plaintiff filed a complaint alleging violation of the Residential Real Property Disclosure Act and common-law fraud. The circuit court held a bench trial and awarded damages in favor of the plaintiff, plus post-judgment interest and attorney fees. Defendant appealed, arguing that the trial court erred when it denied his motion for a directed finding, that the trial court applied the incorrect standard in entering judgment on the merits for the plaintiff, that the damage award was not established to a reasonable degree of certainty, and that the trial court erred in denying defendant’s motion to reconsider.
