Plaintiff/counter-defendant appealed from a trial court order finding in favor of the defendant/counter-plaintiff on its claim for breach of contract and awarding the defendant/counter-plaintiff damages. Plaintiffs also separately challenged a trial court order awarding defendant/counter-plaintiff all of its requested attorneys fees and costs without an evidentiary hearing. The appellate court affirmed in part and reversed in part, affirming the finding in favor of the defendant/counter-plaintiff, affirming all damages exception for a portion of the award for broker’s fees, and reversing the award of attorney fees and costs. The appellate court reversed and remanded for an evidentiary hearing on the fee petition. (LAVIN and COBBS, concurring)
