Civil Court
Animal Control Act
Plaintiff sued for dogbite injuries, under Animal Control Act and common-law negligence. Dogbite occurred at family gathering at house rented by water-treatment plant distribution superintendent, on plant premises. Dog was owned by superintendent, and court properly dismissed defendant water-treatment plant company, as it was not "owner" of dog under Animal Control Act as it did not exercise any measure of care, custody, or control over dog. Although company knew of other dog's dangerous propensities, Plaintiff failed to present any evidence that company knew of such propensities for the dog that bit Plaintiff. (APPLETON and POPE, concurring.)
