Illinois Appellate Court
Civil Court
FOIA
Plaintiff made 3 requests under FOIA to Board of Education, for release of certain records as to policing in the Chicago Public Schools. Court properly dismissed with prejudice, pursuant to Section 2-615, Plaintiff's complaint for willful violation of FOIA. Plaintiff rejected Board's invitation to narrow or clarify its FOIA requests. Board properly exercised its unilateral ability, under FOIA, to extend its own response deadlines by 5 days. A public body asserting a Section 3(g) exemption must make a clear and convincing showing that burden of compliance outweighs public interest in disclosure. Boarde complied in good faith with Section 3(g) by providing written explanation for noncompliance. (PIERCE and GRIFFIN, concurring.)
