Defendant, who was the former president of Police Association, pled guilty to embezzling funds from the Association, which obtained a judgment against him for $690,215. Defendant's wife, in her will, conveyed residence to Defendant's Trust, for Defendant's benefit. In collection proceedings, court properly granted Association's motion for turnover order, as the Trust was invalid under the merger doctrine because Defendant was both its sole trustee and its sole beneficiary.(PIERCE and WALKER, concurring.)
