Legislation
The Section Council reviewed 16 bills that may affect their members’ practice area. Highlights of the most recent legislative session include:
- House Bill 4708 provides that any segment of a lake, river, or stream that is capable of supporting use by commercial or recreational watercraft for a substantial part of the year, or that is actually so used, shall be deemed navigable, and shall be open to public access and use, unless the contrary is proven in litigation by a preponderance of the evidence.
- House Bill 4954 provides for State mine rescue stations that are maintained by the Department of Natural Resources for the sole purpose of responding to and preparing for emergencies in the coal mines of Illinois.
