The mother of the decedent filed a petition for appointment as administrator of the estate and the mother of the decedent’s son filed a counterpetition for appointment as administrator of the estate. The trial court granted the petition of the decedent’s motion without conducting an evidentiary hearing. The appellate court vacated and remanded, finding that the trial court erred by ruling on the petitions for appointment of an administrator before ruling on a related petition by the mother of the decedent’s son to be appointed a guardian of her son’s estate and in failing to conduct an evidentiary hearing.
