In re Estate of Meyer

Respondent appealed from a trial court order construing the will of the decedent and determining succession of the ownership of a parcel of real property. Respondent argued on appeal that the trial court erred in finding that the recipient of the property “resided in” the residence at the time of decedent’s death, which entitled him to sole ownership of the property under the will. The appellate court, however, dismissed the appeal, finding that respondent failed to file a timely notice of appeal pursuant to SCR 304(b)(1). (STEIGMANN and LANNERD, concurring)
