Plaintiff, a skilled nursing facility, filed a lawsuit against the defendant, an estate of a deceased individual, alleging that the decedent had not paid for services provided by the nursing home. The trial court granted partial summary judgment in favor of the plaintiff on the issue of liability and a jury returned a verdict for monetary damages in favor of the plaintiff. Defendant appealed, arguing that the trial court erred in granting partial summary judgment, erred in making certain rulings on evidentiary matters, and erred in determining the damages award. The appellate court reversed, finding that the trial court erred in granting summary judgment on the issue of liability because there were questions of fact as to whether the defendant was eligible for Medicaid benefits.
