Plaintiff filed a lawsuit alleging that the defendant was engaging in deceptive and unfair pricing practices and that discrepancies between shelf prices and register prices violated the Illinois Consumer Fraud and Deceptive Business Practices Act as well as the Illinois Uniform Deceptive Trade Practices Act and other state consumer protection statutes. The district court dismissed the case on the pleadings and denied leave to amend the compliant. The Seventh Circuit reversed and remanded, finding that the complaint stated some viable claims and rejecting the argument that providing a customer with a receipt after payment stating the actual price charged was sufficient to dispel any potential deception or unfairness caused by an inaccurate shelf price.
