Loan Default
Plaintiff initiated a legal action alleging that the defendants defaulted on two promissory notes that were entered into as a part of a settlement agreement to resolve a prior loan default. The district court found for plaintiff after a bench trial and issued a final judgment confirming the sale of defendants’ residential property and entered a deficiency judgment. Defendants appealed and the Seventh Circuit affirmed, finding that the district court did not err in ordering the sale of the residential property or in entering a deficiency judgment amount.
