Plaintiff filed an action under Title VII alleging that his former employer retaliated against him for filing a racial discrimination grievance. The district court granted summary judgment to the defendant on the plaintiff’s claim that the employer unlawfully terminated him for filing the grievance and plaintiff appealed. Plaintiff argued on appeal that the district court erred when it considered a contradictory declaration submitted by the defendant, but did not consider a declaration submitted by the plaintiff. The Seventh Circuit affirmed, finding that the district court did not commit error when it considered the defendant’s declaration and that the declaration submitted by the plaintiff did not present a genuine issue of material fact that would preclude entry of summary judgment.
