Forum Non Conveniens
Plaintiffs filed a lawsuit against the defendants alleging medical malpractice in connection with the birth of their son. Defendant moved to transfer the action to Du Page County under the doctrine of forum non conveniens. The trial court denied the motion and the appellate court allowed defendant’s petition for leave to appeal. The appellate court reversed and remanded with instructions to grant the motion to transfer, finding that after viewing all of the factors the denial of the motion to transfer was an abuse of discretion because the private and public interests at stake weighed “so strongly” in favor of the transfer that it overcame the deference granted to plaintiffs’ choice of forum.
