Plaintiff filed a complaint for injunctive and declaratory relief seeking to enjoin the Illinois Gaming Board from issuing a casino owners’ license for the City of Waukegan by arguing that the city did not comply with the relevant provisions of the Illinois Gambling Act. The circuit court dismissed the complaint for lack of standing and the appellate court reversed. The supreme court reversed the decision of the appellate court, finding that the circuit court correctly dismissed the complaint for lack of standing because the plaintiff did not have a vested right to a certain process and, even it had a right to lawfully conducted certification proceedings, that right no longer existed at the time the lawsuit was filed.
