Valuation of Non-U.S. Businesses and Equitable Division Issues Concerning Foreign Assets
Discover the complexities of the equitable division process when addressing foreign assets that are not subject to in rem jurisdiction in the Illinois court, but the owner is subject to in personam jurisdiction. Additional topics include: how to establish valuation of offshore businesses, the inability to seize foreign property versus the ability to direct a litigant to transfer or sell assets, and the corresponding contempt for failure to comply.

Fair and Equitable Division of Property requires the Court to focus on the economic circumstances of the parties at the time of the divorce to determine what division of resources are fair. The IMDMA provides the statutory factors for consideration in an equitable division. This presentation addresses these factors, and discusses how evidence is presented to force the court to weigh in with a disproportionate award.
