Join us for an in-depth look at a number of important environmental law issues, including the new regulatory developments with coal combustion residuals; the national rules for coal ash disposal; how clients are implementing voluntary nutrient loss reduction practices; the policy framework currently in place to encourage nutrient loss reduction practices; how environmental conditions are being collected remotely; how stormwater management compliance and SWPPP inspections are being impacted by drone imagery; how the Climate and Equitable Jobs Act is shaping the future of the Illinois electricity and natural gas industries; and much more.

Coal Combustion Residuals: New Regulatory Developments and Practice Insights
Coal ash, a residual from coal combustion, is one of the largest types of industrial wastes generated in the United States and potentially has significant environmental impacts due to its contents of mercury, cadmium, and arsenic. To provide environmental protection from this contamination, the U.S. Environmental Protection Agency established national rules for coal ash disposal. This session examines these regulations, as well as the proposed changes for legacy coal combustion residuals surface impoundments, the issues with the management and disposal of coal combustion residuals, and how the rules are enforced.
Moderator: Lisle A. Stalter, Lake County State’s Attorney’s Office, Waukegan
Jennifer Cassel, EarthJustice, Chicago
Ian Cecala, U.S. Environmental Protection Agency Region V, Chicago
Martha S. Thomsen, Baker Botts, LLP, Washington D.C.

Nutrient Loss Reduction in the Agricultural Sector: Method and Practice
The agriculture sector is the subject of significant attention on the nutrient loss reduction front. Implementation of nutrient loss reduction practices remains wholly voluntary. This segment examines the ongoing work with clients implementing these practices, which practices are most popular, and the outlook for further implementation. The legal and policy framework currently in place to encourage implementation is also explored.
Moderator/Speaker: Jane E. McBride, Attorney at Law, Springfield
Gayle C. Baker, P.E., Maurer-Stutz, Peoria

Monitoring and Inspecting Environmental Conditions Remotely; Use of Scientific Evidence and Modeling in Litigation
The first half of this session addresses the evolving use of remote data collection and management in the context of several different environmental management markets. These markets include intended and unintended impacts of drone imagery on stormwater management compliance and SWPPP inspections, use of remote air monitoring for compliance at a superfund remedial action closure, and use of remote stormwater quality data and associated data management and analysis. This data could potentially be used in State and Federal enforcement litigation and private party tort litigation.
Moderator/Speaker: Michael P. Murphy, HeplerBroom, Springfield
Mark R. Willobee, CPESC, Geosyntec Consultants, Inc., Oak Brook
The second half of this segment discusses the use of scientific evidence and modeling in litigation, including discussion of use of this evidence to demonstrate compliance or establish the nature, extent, or source of contamination.
Moderator/Speaker: Matthew Cohn, USG Corporation, Chicago
Ronald B. St. John, St.John-Mittelhauser & Associates, Chicago

The Future of Energy in Illinois: Implementing the Climate and Equitable Jobs Act (CEJA)
Late in 2021, Governor Pritzer signed into law the Climate and Equitable Jobs Act (CEJA, P.A. 102-0662). This blockbuster law set ambitious renewable energy and decarbonization targets that are now being implemented in several important cases at the Illinois Commerce Commission. This presentation provides an update on how CEJA is shaping the future of the Illinois electricity and natural gas industries through the lens of the key cases at the ICC. Our speakers will identify the most important developments in Illinois and put them in context with other Midwest states.

Get the updates you need on several hot topic issues with this informative program! Topics include: how stormwater credit trading can help bring new green stormwater infrastructure (GSI) to communities in need; the barriers to accelerating and advancing the use of natural infrastructure stormwater solutions in Cook County, the recent developments with PFAS; the nutrient requirements in water permits for municipal sources; the opportunity for collaboration on a watershed basis to address nutrient issues; and much more.

An Introduction to StormStore
The Illinois Chapter of The Nature Conservancy has partnered with the Metropolitan Planning Council (MPC), a Chicago-based planning and policy not-for-profit, to explore ways that green stormwater infrastructure can be incentivized in Cook County to deliver solutions to the most flood vulnerable communities. One option currently being piloted with Cook County’s local stormwater utility (MWRD) is stormwater credit trading, a concept that offers an alternative pathway for Cook County developers to comply with local stormwater manag
ement requirements by allowing use of offsite stormwater facilities. Through this pilot, TNC and MPC have identified some clear opportunities where stormwater credit trading can help bring new green stormwater infrastructure (GSI) to communities in need of it, as well as barriers to accelerating and advancing use of natural infrastructure solutions in Cook County.
Moderator/Speaker: James L. Morgan, Attorney at Law, Springfield

PFAS Update for the Environmental Practitioner: What’s in Store for 2024?
PFAS continue to draw intensifying scrutiny from state and federal legislators, the news media, regulators, and public interest organizations. The U.S. EPA pushes ahead with efforts to research, restrict, and remediate PFAS through a suite of significant proposals slated for 2024, while the Illinois EPA continues to contemplate stringent PFAS groundwater standards. While regulatory efforts progress, plaintiffs’ firms have launched dozens of lawsuits targeting consumer products purported to contain PFAS. This session goes beyond “what are PFAS?” and offers an in-depth look at these and other recent developments, including the timing and significance of future regulation, remedial technologies, and implications for environmental due diligence.
Moderator: Matthew A. Walker, Lathrop GPM, Chicago
Gillian Asque, U.S. Environmental Protection Agency Region V, Chicago
Andy Bajorat, BBJ Group, Chicago
Amanda S. Kimmel, Illinois Environmental Protection Agency, Springfield
Steven M. Siros, Jenner & Block LLP, Chicago

Nutrient Requirements in Water Permits for Municipal Sources
According to the U.S. Environmental Protection Agency, discharges from municipal wastewater treatment facilities are a significant source of these nutrients to surface waters throughout the country. Setting permit requirements and treating the wastewater to meet specific effluent limits can reduce nitrogen and phosphorus loading from these facilities, but can also carry significant costs. This session focuses on the Clean Water Act and legal perspective relative to nutrient permit requirements for point sources. Topics include: the relevant caselaw that may impact your clients, the large number of Illinois dischargers that may be subject to these permit requirements, the potential for permit litigation, and the opportunity for collaboration on a watershed basis to address nutrient issues.
Moderator/Speaker: Albert Ettinger, Attorney at Law, Chicago
Fredric P. Andes, Barnes & Thornburg LLP, Chicago

Carbon Sequestration
Carbon capture seeks to trap carbon dioxide produced by industrial activity and store it in a way that it is unable to affect the atmosphere. Carbon capture, utilization, and storage have been the subject of several legislative efforts over the past few years; however, the prospect of carbon dioxide pipelines traversing the State has been met with opposition. Don’t miss this informative segment that offers several perspectives on carbon sequestration, as well as an update on current and proposed legislation.

Bankruptcy and Environmental Issues

What does an attorney do when a client has an environmental problem, but no money to fix it? In other situations where the client has run out of money, the solution might be to file bankruptcy and start over; however, when the financial drain is caused by an environmental condition at the client’s property, a bankruptcy may not be an available solution. This panel discussion gives attendees a basic understanding of bankruptcy law and how environmental liabilities can impact the goals of bankruptcy.
Moderator/Speaker: Eugene P. Schmittgens, Jr., Rouse Frets White Goss Rhodes P.C., Missouri
Joycelyn Bell, Illinois Attorney General’s Office, Chicago
Jonathan Friedland, Much Shelist P.C., Chicago
