Sign, Sign Away
Since 1999, when Illinois passed the Electronic Commerce Security Act (ECSA), Illinois has recognized electronic documents and electronic signatures. Over the last 22 years, the law on electronic documents and electronic signatures has remained largely unchanged—until this year, writes Ray Prather in his November Illinois Bar Journal article, “Sign, Sign Away.”
This year, Illinois repealed the ECSA and passed the following: the Uniform Electronic Transactions Act; amendments to the Illinois Notary Public Act allowing electronic and remote notarizations; and the Electronic Wills and Remote Witnesses Act. In his article, Prather helps all attorneys practicing in Illinois become familiar with these laws so they can understand their ethical obligations for offering electronic documents and remote signings to clients.
