Non-Citizen Criminal Convictions: A Categorical Approach to Determining Deportability
Immigration law is a federal matter, but many criminal convictions are based on Illinois state statutes with state definitions of their terms, making the deportability of an immigrant an extremely complex area of the law. Because of this interplay, the immigration courts use something called the “categorical approach” to determine deportability or eligibility for relief from removal.
