Lobbying as an Illinois Lawyer
In his August Illinois Bar Journal article, “Lobbying as an Illinois Lawyer,” Arthur Miller explores how lawyer-lobbyists can balance their ethical duties as members of the bar alongside the competitive professional ecosystem of lobbying.
For example, he addresses, “What are the ethical considerations that lawyer-lobbyists must keep in mind when engaging in their lobbying practice? Conflicts of interest? Confidentiality issues?” One challenge is that the Illinois Rules of Professional Conduct (IRPC) do not explicitly regulate the ethical conduct of lawyers who have a lobbying practice. But that doesn’t mean the Rules are without application. Miller identifies the potential ethical problems that lawyer-lobbyists face, notes the gap in the IRPC, and proposes guardrails to avoid ethical concerns.
