ISBA President John Thies informs members that federal courts in the Northern District of Illinois could be forced to close in 2013 for one day a week or for the whole month of February. This will occur unless congressional action is taken to avoid sequestration. Please contact your elected representative and encourage them to act at www.contactingthecongress.org.

Some 1.9 million Illinoisans are considered “food insecure,” meaning they lack the ability to secure adequate food. The problem is especially acute for Illinois children, with one in four or over 600,000 children experiencing food insecurity.
These dire statistics were the impetus behind Lawyers Feeding Illinois, a new program announced by ISBA President John E. Thies, a shareholder at the Urbana law firm of Webber & Thies, P.C. Under the leadership of his wife Terry, Lawyers Feeding Illinois kicked off on Nov. 14 with a special event featuring Illinois Attorney General Lisa Madigan.
The program’s goal is noble and simple: collect food and raise funds for distribution to the eight Feeding Illinois member food banks. Law firms and legal organizations statewide will be encouraged to participate in a food and fundraising drive held during the final week in February 2013.
Even the choice of timing has a purpose. Most people loosen their purse strings during the holidays, according to President Thies. But feeding the hungry doesn’t start and stop between Thanksgiving and New Year’s. The campaign, they believe, will help call the public’s attention to the fact that donations are needed year-round.
“No one should ever go hungry because they can’t afford to put food on the table,” Thies says. “Even with the federal breakfast and lunch programs for children, and the federal food stamps program for families and individuals, there are still residents in Illinois who go hungry every day.” -

The following is ISBA President John E. Thies' response to Chief Judge Holderman's letter on the possibility of weekly federal court closings due to budget cuts. ISBA members are urged to join President Thies in this effort by contacting their representatives in Congress. Contact information for Illinois' Congressional delegation can be found at www.illinoisworknet.com
Dear Chief Judge Holderman:I appreciate the opportunity to respond on behalf of the Illinois State Bar Association to your September 4, 2012, letter detailing the perilous situation confronting the federal courts in the absence of positive budgetary intervention by the Congress.
You asked about our views on how our lawyer members and their clients would be impacted if the U.S. Court for the Northem District of Illinois is forced to drastically diminish its operations. I want to focus my response on the effect such action would have on our clients - the parties in civil actions and the individuals involved in criminal prosecutions. It is they who would be most affected by the interruption of court services.

ISBA President John E. Thies was elevated to the position of President of the National Caucus of State Bar Associations at the recent ABA Annual Meeting in Chicago. The purpose of the caucus is to coordinate the efforts of state bar associations across the country in considering and proposing matters before the American Bar Association House of Delegates.
“State bar associations – including the ISBA – have a unique interest in many matters before the ABA House and within the ABA generally," Thies said after being named President-elect of the Caucus in 2011. "These associations are most closely connected to the practicing bar, and the administration of justice at the core level. Accordingly, it is important that state bars have a strong voice within the ABA. In leading the Caucus, I plan to work with other state bar leaders to make sure that this is always the case.”
The National Caucus has been an important resource for the ISBA in connection with the Association’s recent efforts to maintain the ABA’s current position against non-lawyer ownership and fee-splitting with non-lawyers. “The Caucus met in advance of the ABA’s August House of Delegates meeting, and was an important sounding board for us as we decided how to frame this debate in the House.”

President John E. Thies presented ISBA’s position against changing ABA ethics guidelines to permit nonlawyer ownership of law firms and sharing of law firm fees with nonlawyers in debate before the ABA House of Delegates on Monday. The ISBA Board of Governors passed a resolution in support of retaining a previously-adopted ABA policy that disallows such arrangements. ISBA and the ABA Senior Lawyers Division were the lead sponsors of Resolution 10A in the House of Delegates.
Resolution 10A seeks to reaffirm existing ABA policy that dates from 2000 – the MacCrate Resolution. That followed from an effort by accounting firms to provide legal services to their clients.
These accounting firms were dismissive of our ethical rules and persuaded an ABA commission that we should abolish the Rule 5.4 prohibition against the sharing of legal fees with non-lawyers and non-lawyer ownership.
This was Multi-Disciplinary Practice, or “MDP”, and permitting it was described as a critical part of providing better service to clients – it was supposed to be “consumer” friendly.
In actuality, it was an attempt to pad the bottom line at the expense of client service and protection.
